CHAPTER 411 AN ACT TO AMEND CHAPTER 87 OF THE SESSION LAWS OF 1961 RELATING TO THE CHARTER OF THE TOWN OF CHAPEL HILL AND TO REDEFINE THE TOWN LIMITS AND TO PROVIDE FOR CONTINUING ZONING JURISDICTION. The General Assembly of North Carolina do enact:

Chapter 87 of the Session Laws of 1961, entitled An Act to Revise and Reorganize the Charter of the Town of Chapel Hill, is hereby amended by striking out all of Subchapter B, entitled Town 425 Boundaries, in Chapter I, Section 1, and by inserting in lieu thereof a new Subchapter B, entitled Town Limits, to read as follows: SUBCHAPTER B. TOWN LIMITS Section 1.21. Town Limits (a) The corporate limits of the town shall be as hereinafter described with such changes as may be made from time to time in the manner provided by law. As of the effective date of this Act, the said limits shall include all of the area within the following boundaries: BEGINNING at a Town line marker on the original southern line of the Town of Chapel Hill in the northwestern margin of Pittsboro Road (U. S. 15-501 Business); then with the northern and western margin of the said road in a generally southwest direction approximately 2,690 feet to where the southern line of the property of the University of North Carolina intersects the western margin of the said Pittsboro Road; then North 85 degrees 20 minutes West crossing the Old Pittsboro Road and continuing along a line parallel to Smith Avenue and 208.7 feet North of the northern margin of Smith Avenue approximately 2,250 feet to the center line of a branch known as Pritchard Branch; then down the center line of said branch in a southerly direction about 1,300 feet, crossing N. C. 54 Bypass, to the center line of Morgan Creek; then up the center line of Morgan Creek in a westwardly direction about 2,000 feet to the southeastern corner of the Frank Porter Graham School property; then in a northerly direction along the eastern line of the school property about 731 feet to the southern right of way line of N. C. 54 Bypass; then continuing northerly in the same direction about 200 feet to the northern right of way line of N. C. 54 Bypass; then in a northwestwardly direction along the northern right of way line of N. C. 54 Bypass and the exit lane from the Bypass to the southern right of way line of Merritt Mill Road; then in an easterly direction diagonally across Merritt Mill Road about 150 feet to the northern right of way line of Merritt Mill Road at the property corner between Lots 17 and 17A, Block C, Orange County Tax Map No. 100, as revised January 1, 1966; then North along the eastern property line of Lot 17 about 298 feet to the southern property line of Lot 33, Block C, on said tax map the property of Larry Sturdivant; then East along this property line 30 feet to a property corner; then in a northerly direction along the eastern property line of Lot 33, the Sturdivant property, about 585 feet to his corner, the end of Wentworth Street; then North 87 degrees 5 minutes West along a property line about 155 feet to a property corner, also a corner of the corporate limit line of the Town of Carrboro; then following the common boundary line with the Town of Carrboro as established by Act of the 1967 General Assembly and, except as noted, following property lines, 5,939 feet with courses and distances as follows: North 87 degrees 5 minutes West 150 feet; North 35 degrees 24 minutes East 947.4 feet; North 75 degrees 0 minutes East 275.3 feet; South 3 degrees 0 minutes East 53 feet; North 86 degrees 0 minutes East 85 feet; North 2 degrees 35 minutes East 21.7 feet; South 84 degrees 0 minutes East 99.3 feet; North 78 degrees 25 minutes East 86.5 feet; North 56 degrees 30 minutes East 120.9 feet; North 77 degrees 426 10 minutes East 126.5 feet; then across the property of Constructors Supply Co. North 43 degrees 45 minutes East 168.09 feet; then continuing across the property of Constructors Supply Co. Lot 9, Block J, Orange County Tax Map No. 92, as revised January 1, 1966, South 89 degrees 27 minutes East 280 feet to a property corner; then continuing South 89 degrees 27 minutes East 290 feet to the center line of Merritt Mill Road; then along the center line of Merritt Mill Road as follows: North 0 degrees 5 minutes East 95.86 feet to a point in the intersection of Cameron Avenue and Merritt Mill Road; then North 17 degrees 20 minutes West 106.87 feet; then North 20 degrees 55 minutes West 932.48 feet; then North 24 degrees 6 minutes West 519.26 feet to the northern right of way line of West Rosemary Street; then along the northern right of way line of West Rosemary Street South 83 degrees 30 minutes West 20 feet to a property corner; then along a property line North 3 degrees 25 minutes West 130 feet; then South 83 degrees 30 minutes West 82 feet to the western right of way line of Sunset Drive; then North 7 degrees 15 minutes West along the western right of way line of Sunset Drive 270 feet to a property corner; then South 86 degrees 0 minutes West along a property line 88 feet; then North 5 degrees 53 minutes West 155.07 feet crossing Starlite Drive; then South 86 degrees 0 minutes West 76.8 feet; then North 7 degrees 9 minutes West 450 feet; then South 83 degrees 19 minutes West 160.57 feet; then North 6 degrees 24 minutes West 149.26 feet to a common corner of the Chapel Hill and Carrboro corporate limit lines; which point is on the original eastern line of the Town of Carrboro and is North 25 degrees 28 minutes West, 40.95 feet from the original northwest corner of the Town of Chapel Hill; then continuing North 6 degrees 24 minutes West 655 feet along the rear property lines of the lots on the West side of Bynum Street, to a property corner; then along a property line North 78 degrees East 138 feet to a western right of way line of Bynum Street; then South 60 degrees East 85 feet diagonally across Bynum Street to the eastern right of way line of Bynum Street and a property corner located about 150 feet North of Gomains Avenue; then North 75 degrees East 225 feet along the rear property line of the lots on the North side of Gomains Avenue to a point; then North 3 degrees West 22 feet and North 8 degrees East 100 feet along the rear property line of the lots facing Sykes Street to a property corner; then South 86 degrees East along a property line 120 feet to the western right of way line of Sykes Street; then continuing South 8&6 degrees East 48 feet across Sykes Street to its eastern right of way line at the northwest corner of the property of the Chapel Hill Housing Authority; then following the property line of the Chapel Hill Housing Authority North 74 degrees East 190 feet, South 22 degrees East 100 feet, and North 69 degrees East 150 feet to the western right of way line of Edwards Alley; then approximately South 74 degrees East diagonally across Edwards Alley 40 feet to the eastern right of way line of Edwards Alley at a property corner; then North 69 degrees East along the rear property line of properties facing Gomains Avenue 127 feet to a property corner; then South 22 degrees East along a property line 125 feet to a property line which would be the eastward extension of the North right of way line of Gomains Avenue if the same were extended eastwardly; then 427 North 69 degrees East along this property line about 60 feet to the center line of Tanyard Branch; then down the center line of Tanyard Branch in a northerly direction about 2,500 feet to its intersection with Bolin Creek; then down Bolin Creek in an eastwardly direction about 7,200 feet to its junction with Cole Springs Branch; then upstream with the center line of Cole Springs Branch in a northerly direction, along the property line of the area known as Hidden Hills, approximately 1,680 feet to a corner of the area known as Estes Hills; then continuing upstream with the center line of Cole Springs Branch in a northerly and northwestwardly direction approximately 1,645 feet to a corner of the Estes Hills property; then North 1 degree 59 minutes East 597.7 feet; then North 88 degrees 33 minutes West 312.3 feet; then North 86 degrees 23 minutes West 168.6 feet; then North 0 degrees 19 minutes West 428.9 feet; then North 87 degrees 34 minutes West 133.8 feet; then North 18 degrees East about 400 feet to the center line of Estes Drive; then with the center line of Estes Drive South 89 degrees 33 minutes East about 500 feet to the corner of the Guy B. S. 15-501; then in a northeastwardly direction along the right of way of said highway 250 feet; then approximately South 62 degrees East about 740 feet across the highway right of way to the eastern right of way line of U. S. Highway 15-501 Bypass at its intersection with a line parallel to and 200 feet in a northeastwardly direction from the northeastern right of way line of 428 Ephesus Church Road; then South 38 degrees East parallel to the northeastern right of way line of Ephesus Church Road about 750 feet to the northwestern right of way line of Legion Road; then South 40 degrees East about 60 feet across Legion Road to its southeast right of way line at a property corner; then South 71 degrees 16 minutes East along a property line 1,124 feet to the northern corner of Lot 183A, Block D, Orange County Tax Map No. 27, as revised January 1, 1965; then South 2 degrees 47 minutes East along the eastern line of said Lot 13A 543 feet to a property corner; then South 86 degrees 30 minutes East along the northern line of Lot 12, Block D, said map 184.8 feet; then South 6 degrees 47 minutes West along a property line 209.35 feet to the northern right of way line of Ephesus Church Road; then in a southerly direction across Ephesus Church Road about 60 feet to its southern right of way line at a point on the extension of the eastern boundary line of Ridgefield Park Subdivision; then following the eastern boundary of Ridgefield Park Subdivision South 8 degrees 51 minutes East 1,960 feet; and South 0 degrees 47 minutes East 165.9 feet to the northern right of way line of LeClair Street; then crossing LeClair Street South 46 degrees East about 80 feet to the southern right of way line of LeClair Street at a property corner; then following property lines South 11 degrees 19 minutes East 115.57 feet; South 13 degrees 29 minutes West 57.57 feet; South 56 degrees 12 minutes East 62.47 feet; South 6 degrees 23 minutes East 99.53 feet to the northern right of way line of Wildwood Drive; then in a southerly direction across Wildwood Drive about 60 feet to a property corner, the northeast corner of Lot 3, Block E, Orange County Tax Map No. 51A, as revised January 1, 1965; then South 4 degrees 43 minutes East 130 feet; then South 26 degrees 2 minutes West 53.98 feet; then following the southern property line of Ridgefield Park, Section IV North 88 degrees 56 minutes West about 1,500 feet to the center line of Booker Creek; then down the center line of Booker Creek in a southerly direction about 1,550 feet to the southern bank of Bolin Creek; then along the South bank of Bolin Creek North 48 degrees 24 minutes West 450.9 feet to a point where the eastern edge of Rogerson Drive extended intersects Bolin Creek; then South 6 degrees 58 minutes West with the eastern edge of Rogerson Drive 5,462 feet to the center line of N. C. 54 (Raleigh Road); then southeastwardly along the center line of N. C. 54 past the entrance to Mason Farm Road 1,049.30 feet to a point on the extension of the eastern line of Lot 1, Block D, Orange County Tax Map No. 65, as revised January 1, 1965; then along the eastern edge of said lot South 4 degrees 57 minutes East 320 feet to a corner of the University of North Carolina golf course property; then North 85 degrees 6 minutes West 301 feet to the center line of Mason Farm Road; then with the center line of Mason Farm Road in a southerly direction 1,682 feet to a point; then leaving the Mason Farm Road North 77 degrees 57 minutes West 210 feet; then North 5 degrees 47 minutes East 1,143.20 feet; then North 27 degrees 34 minutes West 518.8 feet; then North 30 degrees 51 minutes East 202.5 feet to the center line of Preswick Road; then with the center line of Preswick Road in a northwestwardly direction to its intersection with a street at the northeast corner of the Glenwood School property; then South 6 degrees 0 minutes 429 West 1,840 feet; then North 84 degrees 0 minutes West 1,981 feet to the center line of U. S. 15-501 Bypass; then in a southerly direction with the center line of U. S. Highway 15-501 Bypass 1,577 feet to the point where said highway crosses the Meeting of the Waters Branch; then with the center line of the Meeting of the Waters Branch upstream in a northwestwardly direction approximately 3,455 feet to the eastern line of the property of the University of North Carolina; then with the said line of the University of North Carolina North 5 degrees 13 minutes East 1,745 feet to the point where the said University line intersects the original southern line of the Town of Chapel Hill; then with the original southern line of the Town of Chapel Hill South 64 degrees 32 minutes West 4,068.10 feet to a Town line marker on the northwestern margin of Pittsboro Road, the point of BEGINNING. Excluded from the area described above is a tract of land described as follows: BEGINNING at the point where the eastern right of way line of U. S. 15-501 Bypass intersects the center line of Bolin Creek; then upstream along the center line of Bolin Creek about 3,100 feet to a point 200 feet East of the eastern right of way line of U. 8 15-501A (East Franklin Street) then in a northerly direction parallel to and 200 feet from the eastern right of way line of U. S. 15-501A (East Franklin Street) 3,450 feet to the West property line of the Crowell-Little Motor Company; then with the line of the Crowell-Little Motor Company South 30 degrees East about 786 feet; then North 84 degrees East about 290 feet to the center line of Booker Creek; then down the center line of Booker Creek in an easterly direction about 800 feet to the eastern right of way line of U. S. 15-501 Bypass; then in a southerly direction along said right of way line about 2,725 feet to the center line of Bolin Creek the point of BEGINNING. (b) The current town limits, at all times, shall be shown on a map or by a written description or by any combination thereof, to be retained permanently in the office of the town clerk and to be designated, as the case may be, Map (or Description) of Chapel Hill Town Limits. Alterations in these limits shall be indicated by appropriate entries upon or by additions to or by the redrawing of such map or such description. Such changes, entries or additions shall be made by or under the direction of the town manager. A redrawn map or redrawn description shall supersede for all purposes the earlier maps or descriptions which it is designated to replace. Photographic, typed or other copies of such map or description, certified by the town clerk, shall be admitted in evidence in all courts and shall have the same force and effect as would the original map or description.
