CHAPTER 437 AN ACT AMENDING CHAPTER 938, SESSION LAWS OF 1963, ENTITLED AN ACT TO REVISE AND MODIFY THE CHARTER OF THE CITY OF ROCKY MOUNT, RELATING TO COMPOSITION OF THE ROCKY MOUNT PLANNING BOARD AND BOARD OF ADJUSTMENT. The General Assembly of North Carolina do enact:

The Charter of the City of Rocky Mount, being Section 1 of Chapter 938 of the Session Laws of 1963, as amended, is hereby further amended as follows: (a) By deleting Section 301(b) thereof in its entirety and inserting in lieu thereof the following: (b) There is hereby created the Rocky Mount Planning Board which shall consist of 10 members. Five of said members shall be citizens and residents of the City of Rocky Mount and appointed by the City Council of the City of Rocky Mount; five of said members shall be citizens and residents of the territory beyond the corporate limits of the City of Rocky Mount and within one mile thereof, in Nash or Edgecombe County with membership apportioned between Nash and Edgecombe Counties as provided by ordinance adopted by the City Council of the City of Rocky Mount with approval of the Board of Commissioners of Nash and Edgecombe Counties. All members from the territory beyond the corporate limits of the City of Rocky Mount shall be appointed by the Board of County Commissioners of the respective county in which they reside and shall have the same powers and duties as the other members of the Rocky Mount Planning Board, and the laws, ordinances, rules and regulations applicable to the members of the Rocky Mount Planning Board shall be applicable to said member. (b) By deleting Section 302 thereof, entitled Board of Adjustment and inserting in lieu thereof the following: 448 Sec. 8302 There is hereby created the Rocky Mount Board of Adjustment which shall consist of 10 members; five of said members shall be citizens and residents of the City of Rocky Mount and appointed by the City Council of the City of Rocky Mount; five of said members shall be citizens and residents of the territory beyond the corporate limits of the city and within one mile thereof in Nash or Edgecombe County with membership apportioned between Nash and Edgecombe Counties as provided by ordinance adopted by the City Council of the City of Rocky Mount with approval of the Boards of Commissioners of Nash and Edgecombe Counties. All members from the territory beyond the corporate limits of the City of Rocky Mount shall be appointed by the Board of County Commissioners of the respective county in which they reside and shall have the same powers and duties as the other members of the Rocky Mount Board of Adjustment, and the laws, ordinances, rules and regulations applicable to the members of the Rocky Mount Board of Adjustment shall be applicable to said members. The Board of Adjustment shall appoint such attorney or attorneys to advise it as appears necessary, except, however, that such attorney or attorneys shall not be the same person or persons as are the City Attorneys.
