CHAPTER 142 AN ACT TO AMEND THE STATUTE PROHIBITING CERTAIN NUISANCES. The General Assembly of North Carolina do enact:

G. S. 19-1 is hereby amended to read as follows: $ 19-1. What Are Nuisances Under This Chapter. Whoever shall erect, establish, continue, maintain, use, own, or lease any building, erection, or place used for the purpose of lewdness, assignation, prostitution, gambling, illegal sale of whiskey, or illegal sale of beer, or illegal sale of narcotic drugs as defined in the Uniform Narcotic Drug Act is guilty of nuisance, and the building, erection, or place, or the ground itself, in or upon which such lewdness, assignation, prostitution, gambling, or illegal sale of whiskey, beer, or narcotic drugs is conducted, permitted, or carried on, continued, or exists, and the furniture, fixtures, musical instruments and contents, are also declared a nuisance, and shall be enjoined and abated as hereinafter provided. Provided, that the illegal sale of beer shall not be declared to be a nuisance where the person or building sought to be enjoined is subject to the provisions of the Beverage Control Act of 1939. 197
