CHAPTER 62 An act to amend the charter of Elizabeth City, North Carolina. The General Assembly of North Carolina do enact:

By striking out section forty-nine and :nserting instead thereof the following: The board of aldermen sinall have the power to require every owner of real estate in Klizaneth City tu furnish material for paving the sidewalks m front of his or her land in the improved portion of said town with such material, either brick, stone or other durable material, and enforce such requirements by proper fines and penalties: Provided, however, the said board of aldermen may in their disereiion assess against the owner or owners of said lots only a portion of the costs of the same, as in their judgment and liscretion may seem just, and upon the failure of such owner or owners to furnisa said material the said corporation of Ei:zabeth City may have the same done, and the cost thereof may de assessed against the property of such delinquent and added to the taxes against hina or her and collected in the same manner that other taxes or assessments are collected, or judgment may be taken by the corporation of Elizabeth City before any justice of the peace or the mayor of Elizabeth City if under fifty dollars, or in the superior court of Pasquotank county if over fifty dollars, for the actual cost of such material delivered at the place of paving.
